The death sentence for Boston Marathon bomber Dzhokhar Tsarnaev has been vacated by the 1st Circuit Court of Appeals. The court ruled that the judge erred in not adequately screening jurors for their exposure to publicity surrounding the case.

All I can say that I hope the Justice Department appeals this, and if, necessary re-does the penalty phase. This case cries out for the death penalty. Pre-trial publicity is a legal issue in jury selection, but how could any normal person not have been exposed to publicity regarding this case? You would need a jury of 12 cave men to find people who were not exposed to the publicity.
