UC Berkeley Law and Affirmative Action

Erwin Chemerinsky


Erwin Chemerinsky is the dean of the UC Berkeley Law School. Both have been featured often on this site. Today, Dean Chemerinsky is back in the news, at least for Breitbart because I don't think the mainstream news is going to cover this much. Someone in the audience at UCB videotaped Chemerinksy on the day of the Supreme Court's historic decision regarding college admissions. In this instance, Chemerinsky was explaining to his audience how the law school handles the issue of diversity hiring. They just don't say anything or put anything on paper. They just vote for the minority candidate. As the tape ends, Chemerinksy is going on to explain how this is much harder when it comes to student admissions because there are statistical records........

In the video, Chemerinsky tells the audience that if he is ever deposed, he will deny saying this. 

The video can be accessed here on Breitbart. The article is written by Alana Mastrangelo. The video appears on a tweet by Christopher F. Rufo. I do not know if he was the one recording.

I'm going to try and be fair here to Dean Chemerinsky. The video clip is short, and the dean may want to argue that he is taken out of context, and that only the full video of his talk would be appropriate. Perhaps. Nor am I arguing the truth of what he said.

Mr Chemerinsky is a well-known law professor, dean of the UC Berkeley Law School, and previously the dean of the UC Irvine Law School. He certainly doesn't need my legal advice, but I will give it anyway. Dean Chemerinsky, if you are ever deposed, I am certain that you will not deny ever saying those words.
