Cute way to up your take of the Google cash flow. Why don't you use this space to point out something useful, like the fact that Elena Kagan advocated that to be protected by the First Amendment, speech has to first be subjected to a balancing test to see if it serves some societal good? That was enough to motivate me to write both my senators (who both serve on the Judiciary Committee, about voting no, or at least questioning her closely on the point.

P.S. Condolences on your senate candidate. I would never vote for him, but he had some sincerity and integrity that the winner utterly lacks. At least he knew what he stood for and laid it out honestly.

I first ran across it in a comment at Front Porch Republic, on a post by Jeff Taylor about Kagan. I googled the quote to confirm from several sources that she actually wrote that in a submission to the Supreme Court on behalf of the government.

Now, it must be noted that a lawyer representing a client, even the government, has a duty to try any argument that will help their client win the case. She could beg off with the Alito excuse -- that stuff he wrote in the 1980s was just to make himself look good in a job application. Maybe its not what she really believes.

But, its enough to worry me.


P.S. I have to say I couldn't quite get the point of WHAT it is you don't like about Leahy -- name-calling without substantive criticism.

This is a case called "United States v. Stevens." It concerned a federal statute prohibiting distribution of images of animal cruelty. In the U.S. government's defense of the law, Kagan as cited in the court's opinion, asserted that a claim of categorical exclusion should be considered under a simple balancing test:

“Whether a given category of speech enjoys First Amendment protection depends upon a categorical balancing of the value of the speech against its societal costs.” Brief for United States 8; see also id., at 12.

Chief Justice Roberts, writing for a majority of the court, responded:

"As a free-floating test for First Amendment coverage, that sentence is startling and dangerous. The First Amendment’s guarantee of free speech does not extend only to categories of speech that survive an ad hoc balancing of relative social costs and benefits. The First Amendment itself reflects a judgment by the American people that the benefits of its restrictions on the Government outweigh the costs. Our Constitution forecloses any attempt to revise that judgment simply on the basis that some speech is not worth it."

Only Justice Alito dissented.
