Discredited former University of Colorado Ward Churchill, who gained notoriety a few years back when he called victims of 9-11, "little Eichmann's" suffered a recent judicial defeat when a Colorado judge threw out a jury's decision that the university had fired him unfairly. As things stand now, Churchill is still out of a job though surely picking up a few bucks by making the university lecture circuit before audiences of fellow America-haters eager to hear the worst about our country.
Churchill's argument was that he was being fired by the university for his political statements and criticism of the university itself. The judge felt otherwise, feeling that the university was within its rights to can Churchill for its findings that he had engaged in plagiarism and false scholarship in his writings.
Not surprisingly, Churchill has broad academic support around the country since he is far from being the only far-leftist to be found in American universities.
Cary Nelson, a lefty activist, who is the national president of the American Association of University Professors (and apparently, a legal expert), said that "there are so many problems with the judge's decision that it would require a full essay to respond to them."
"Ultimately", Nelson opined, "the (original) jury recognized that the university president's decision to fire Churchill was fruit of the poisoned tree -- the public outrage over Churchill's extramural speech. But it was the judge's responsibility to honor the jury's decision by reinstating him."
"Fruit of the poisoned tree", says Cary Nelson, the legal expert. I may not be a lawyer, but the legal concept of "fruit of the poison tree" refers to evidence being excluded from trial, that while itself, was seized legally, would not have been discovered had it not been for an illegal search or other activity by law enforcement. As a DEA agent, it was a basic concept of search and seizure that I had to be aware of in my duties. It has nothing to do with what Mr Nelson is referring to. Perhaps, he was just using it as a figure of speech. (Nelson is a professor of English at the University of Illinois.)

Anyway, CU can now hopefully forget about Mr Churchill. But don't shed tears for the departed "professor". He is going around giving speeches telling young minds what a terrible country they live in. Hell, he was at my school, UC-Irvine, a couple of years back courtesy of the Muslim Student Union, blasting away at Israel. Unfortunately, I was in class at the time.
Ward Churchill is nothing more than a misfit, who has spent a lifetime hating his country. Sadly, there are many others like him in universities throughout North America who dominate the Humanities departments of their institutions. What is really scary is these characters are teaching our kids.
I understand the jury awarded him $1. I wonder what his legal fees were, and when the Moonbats in Hollywood will hold a special concert to help him pay for it.
