According to the court, it is clear that the man on that day was in the area "to look for a girl to rape, that he didn't care if the girl was a child, that he wanted have vaginal intercourse with her, and that, during the attack, he told her open her legs", which is contained in the judgment.
From the Migration Board's opinion, the man, who is a citizen of Libya, has been in the country (Sweden) with a permanent residence si8nce November 2010. He has three minor children in Sweden and on many earlier occasions, has been convicted for violence and theft crimes, but without being deported.
The penalty is 6 years in prison with deportation from the country for 15 years. The man will also pay damages to the girl in the amount of 170,000 kronors.
In the judgment, the man can return to Sweden at the earliest on 28 December 2033. The immigrant is also convicted of minor assault, two cases concerning sexual molestation, theft, minor drug offenses as well as knife crimes.
The chief member of the court differed in the opinion in that he wanted to give the pedophile rapist five years in prison. This was (based) on the reason that the man surrendered himself to the police. "Different from the majority, I (believe) that the fact that the (man) voluntarily declared himself constitutes cause for sentencing relief," he pointed out.
