Erwin Chemerinsky Bemoans Supreme Court "Judicial Activism"

UC Irvine's liberal Law School Dean Erwin Chemerinsky has an op-ed in the Orange County Register bemoaning recent Supreme Court decisions, which he characterizes as "conservative judicial activism".

I guess it depends on whose ox is being gored. Indeed, conservatives like me have longed complained about judicial activist judges determined to set law rather than interpret it. Yet if ever we need a court to limit the excesses and abuses of power coming out of Washington these days, now is the time. On those points we can argue forever, but I do take note of Chemerinsky's comments about union membership and the Hobby Lobby case.
In the former, let's face it; Chemerinsky is pro-union, and I guess he has no problem with employees having to join one whether they want to or not.
In the Hobby Lobby case, Chemerinsky joins with other liberals such as Hillary Clinton in overlooking the fact that Hobby Lobby was not denying contraception coverage to its employees. They were and are covering 16 different contraceptive methods. What they did not want to cover was the so-called Morning After pill because they consider it a form of abortion. They are not taking the position that their employees cannot use this method. All they are saying is you can pay for it yourself because we don't want to. Unfortunately, there are some things in life we should pay for ourselves.

I'm going to go out on a limb here, but if, God forbid, President Obama gets another Supreme Court justice appointment, I wouldn't be surprised if he chose Chemerinsky. Like I said, God forbid.
