Governor's Conference in Boston

Did you know there's a governors conference going on in Boston?


"Yeah I did."


There's a couple of governors now.


Must be a great time to be a hooker in Boston about now. (You think I'm making that up, don't you?)

So far, the one notable thing is that some Democratic governors are stating that the Obama administration is hurting them by pushing this challenge to the Arizona immigration law.

Which leads to Eric Holder's comments over the weekend about his strategy in taking the Arizona law to court.

Question: If the administration is concerned about racial profiling, why is the lawsuit focused on the supremacy of jurisdiction of the Federal Government?

At this, Mr Holder holds out the possibility that a later challenge may come from DOJ focusing on the racial profiling aspect. Of course, that approach will depend on complaints of racial profiling coming forth if and when the law takes effect. They have no such actual complaints yet.

Of course, we know that the Arizona law basically mirrors the federal law, and that Governor Jan Brewer specifically added language prohibiting racial profiling before she signed it.

Both of the above points lead to another question: Racial profiling is a concern no matter who is enforcing the law. Can the Border Patrol or ICE engage in racial profiling? Of course, this question is more pertinent away from the border. (The profile of an illegal immigrant is pretty clear at the border.) The point is that an ICE agent, say in Phoenix, has to avoid racial profiling as much as an Arizona cop does.

It all could be avoided if the federal government were to do its job-which it is not. Do you think that many of the Democratic governors are afraid of similar legislation coming to their own states?
